What’s wrong with this is Cernivich is using quotation marks. And yes the definition of caprice (whim; fickleness) is difference than consequence (result; importance). I don’t have time to read the whole thing, but perhaps the sentence was much lighter than it should have been because the judge did need to “protect” the rioter and Cernivich was just trying to convey that?

Wow, you have to love how they are excusing this behavior as a consequence of fate. The object of the game is to discourage this kind of deviant behavior not excuse its consequences.
As for the analogy of the twin speeders, the object is to ELIMATE or DETER the violation of the law, i.e. speeding, BECAUSE in both instances it CAN and IS likely to cause harmful outcomes which may lead to harsher crimes and consequences.
Just because there are 2 speeders, one doesn't harm anyone and the other kills someone as a result of their speeding. The response should be for the 1st-you are lucky for the 2nd-you are not and are going to have to pay the price for your behavior.
