Tell them that they can request it in writing from your physician. When they say that the MD won’t tell them, ask why not. When they say it’s because the doctor said that that’s private medical info that they’re not privy to, say this: “Oh.” Then sashay to your desk.

Fill out that form and just write down: Everyone employed above my pay grade needs to disclose their medical records for me to decide if I want to continue working here. You can't work with supervisors with HIV, Hepatitis, or Herpes or some other vaccine induced problem.

You can ask all you want, but I don't have to give you a damn awnser.

You also don't have to awnser to getting weekly testing, because again that is none of their business.

Trying to compel you either way is a violation of HIPPA.

I’m not saying it’s right, I’m simply saying it’s not a violation of HIPAA. No, you don’t have to give it but asking or, as you state, trying to compel, isn’t a violation of HIPAA.

Is it discrimination? Because requiring unvaxxed to wear masks and test weekly while not requiring the same for vaxxed seems like they are singling out people for discrimination. The unvaxxed being the only ones walking around the office with the "shame" of their decision right there on their faces.

I feel for you, I truly do. Until SCOTUS shot down the OSHA mandates this week I was in your position. Having 4 kids to feed it was scary for sure. But I was resigned to never taking the clot shot. Actually I went ahead and applied for another job Thursday. Don’t know that I want to work for a company that will blindly follow unconstitutional orders like that. Hold strong anon. God will provide, He always has and always will.

I had to retire early from my job, as there was no way to determine whether they’d make me forfeit my pension if I were fired for not getting shots. As a 35+ year employee, I’ve never contributed to social security, so pension is my only option at my age.

Just when I figured the new administration would put off my retirement due to the economy, I had to leave early.

They said they agreed with my religious exemption, but couldn’t accommodate it. We had weekly testing and mask wearing for most of the past two years, and nobody has ever explained what accommodations other than shots would be necessary and an undue hardship for the agency.

Office workers in my agency were actually fired when they had verified severe allergic reaction to the first shot and multiple physicians said further shots could be deadly for them. Only one shot=unvaxxed to these awful bastards. This is beyond unacceptable.

Lol. State employee. Great job, residential care for adults with developmental and physical disabilities. Lotsa money to be made these day with all the overtime you want (or don’t want but still have to work). Just gotta be jabbed whenever they say so.

Damn! You must work at my job! Same thing here. They claim they just want to know but I don't trust that. In my case, I can't wait to be fired. I'll have to retire, even though I'm not eligible for my 401k or SS. But I have about 300 grand in pension I'll lose if I get fired. So I'll take their money and go home. My mechanic and I have been talking about opening a business together. I'll be the business, he can do the repairs.

If you're some kind of technical person, see if your employer will rehire you as a consultant. They can justify not requesting jab status for independent contractors.

No unfortunately not. I'm an operator in a chemical plant. Not sure how much longer. Their decision. I'll survive, not sure if they will! It'll take up to 3 years to train someone for my position. And we're already short handed. They'll be cutting their own throat since we only have 4 board operators for 4 shifts.

I have looked everywhere to see if there is protection for our vaccination status. They can ask you but they can't ask you why you haven't been vaccinated. I don't know what to do. I have till the 24th to decide. I checked state law as well. There is no protection.

You are doing it right, keep it up. Don't get angry if they confront you, just tell them your medical business is yours and this form in itself is an attack on your privacy. If they say mark it that you choose not to disclose, tell them you are not agreeing to any stipulations they set on their paperwork, therefore cannot fill it out at all.

If they fire you contact america's frontline doctors and sue them.

My workplace has also requested our vaccination status, I live in ohio. No one has confronted me about it, honestly I don't think they have the balls to, and if they ask the Hippa monster is coming out.

I'm still unclear if they legally can or cannot ask such a question. HIPPA is for doctors and privileged information and isn't really framed around corporations knowing something medically about you.

I just really haven't seen anything concrete and worry that sticking to your guns for the vax status may not unfold favorably legally. I'd like to be shown I'm wrong.

My employer is doing the same. They say they're only doing a "soft" mandate since they allow us to either be vaccinated OR submit to weekly testing and wearing a mask even if you're by yourself. They said in their email that by submitting our vax status, it will help the company better enforce the mask policy. What does that tell you? That sounds like a company admitting to discrimination. After all, how can they "better enforce" a mask policy when they have a list of people that aren't vaxxed? I've been going through hell the past few days but I seem to be winning so far. I am praying for all of you that are going through this BS with me. Stay strong people, and never stop standing for what you know is right.

Do not play their game; do not answer; do not participate in violations of your rights; do not legitimize their unlawful actions.

By the 4th Amendment, you have the right to be secure in your person; free of unreasonable searchs and seizures. If they want that info they need to obtain a warrant, but only after the showing of probable cause.

By the 5th you cannot be deprived of your property without due process of law. Health information is private property.

I have not complied with any CV mandates, orders, rules, etc. My managers disbanded a meeting, because I wouldn't mask up. They can't handle open, in their face defiance.

they cannot fire you for non-disclosure. That’s a fact. If they do you have a case. If you tell them your status and they fire you for that, then there’s less of a case. But it’s completely illegal for them to fire you for not disclosing. That is literally the reason they’re trying to get you to disclose the info.

This isn’t correct. Let’s not throw out misinformation, that’s what the deep state fuckers do. If the state is at-will then they can fire OP because they don’t like their shirt color. Unfortunately we (employees) don’t have the protections we should. By not disclosing, OP isn’t meeting the conditions of their employment. The business is the protected one.

Well, as prior management, I disagree with your opinion on the protections. There are goldbrickers and passive=aggressive employees out there that don't deserve protecting, with regard to work product and continued employment. Need a way to remove those people. This is not the forum to hash that out, though. This attempt to enforce a mandate, however, is another situation altogether.

Oh, I totally agree. There are some companies that are so scared of retaliation (lawsuit) that they continue to let POS employees continue working instead of booting them like they should. It’s absolutely annoying.

No, it absolutely is correct. The federal government in leaked documents said the the ENTIRE REASON for the previous vax deadline was to intimidate people into disclosing their vax and religious status.

Your employee cannot compel you to disclose your medical record. Period. Look it up before you speak again.

How about you calm your hostility. Yes, an employer can “compel” you by saying do it or your fired. If they make it a condition of employment then they can can fire you for non-disclosure. I didn’t say I like it or agree with it. A drug test is part of your medical record and they can force you to disclose the results. Sorry you’d rather live with misinformation.

Let me say it slow for you:

IT IS AGAINST THE LAW FOR AN EMPLOYER TO FIRE AN EMPLOYEE FOR NOT DISCLOSING PRIVATE HEALTH RECORDS.

And it’s not in the legal quandary like firing someone for their DISCLOSED vax status.

You don’t know what you’re talking about. The entire reason the government told people to submit medical exemptions was to trick them into disclosing both vax and religious status.

Company policy can’t violate the law. Company policy that says “you must disclose private health records” breaks the law. It’s that simple. No one has to disclose their status.

Try to hold these two things in your mind at once:

  1. It is illegal for a company to fire an employee in the basis of the employee not disclosing private health records (read the Americans with Disabilities Act).

  2. Employers still may fire people but it will be an illegal firing. If someone DISCLOSES THEIR STATUS, however, they implicitly consent to being subject to company vax policy, which is less likely to be protected for the employer due to the labyrinth of mandates, and more likely to result in no recompense for the fired employee.

Your links don’t address this legal framework. That’s because you don’t understand the concept I’m laying out and you don’t understand that at different stages of the consent process, different legal principles are in play.

Why do you want people to think they have to tell their boss their health status?
