The "shouting fire in a crowded theater" mantra came from an offhand analogy by justice Oliver Wendell Holmes in a 1919 Supreme Court decision, Schenck v. United States. That decision was overturned in 1969, Brandenburg v. Ohio.

The Schenck decision also gave us the nebulous "clear and present danger" limit by the government on free speech/press/assembly which was replaced by the Brandenburg decision with "imminent lawless action." With the Brandenburg test, the government has to prove three elements: intent, imminence and likelihood.

The precursor to the Communist Party USA was the Socialist Labor Party of America, whose logo was an arm holding a hammer. Julius joined the SLP in 1892, two years after arriving from Odessa. His son, Armand, is believed to have been named after the SLP emblem in 1898. Then in 1919 Julius founded the CP-USA. A J. Edgar Hoover memo once said that the FBI couldn't go after Armand Hammer because he was being protected by Senator Al Gore Sr., the VP loser's dad.

I was surprised to learn that the Arm&Hammer baking soda company isn't connected to that family, at least back then.

That family was heavily communist. This dude's great-great-grandfather (Julius) founded the American Communist Party after immigrating here from ukraine. His great-grandfather (Armand) was suspected of performing an illegal abortion and killing a woman in 1919, but Julius took the rap and did 3 or 5 years in Sing Sing prison for manslaughter. The Hammers were constantly under surveillance for their communist ties.

Can't believe Leahy is still around. He's been a senator for almost 50 years! He only won in 1975 as a democrat in Vermont because of the Nixon stuff that was decimating the entire republican party at the time. Vermont was always republican before him.
