I was kicked out of a store today for refusing to wear a mask. The girl (I’m guessing, always hard to tell with these people) handed me a mask as I walked in. I continued to walk without putting it on my face. She FOLLOWED me and, causing a scene, told me I needed to put it on my face or leave. I turned around, dropped the mask on the floor and walked out leaving my boyfriend standing there with his mask on. I’m DONE with this.
Side note: I also witnessed a man wearing gloves use hand sanitizer today... on the gloves. I’m fucking done. Get me out of this nightmare.
This is a crime. Look up the law for harassment in your State. In mine it says--

In my 27 page Cease and Desist demand, I provided all the laws they were in violation of. Including OSHA regulations. I gave them 10 days to respond and offered to meet with them to resolve the issue. Their response costs them money and ties their time up costing them more money.
Stores in theory can ask you to leave, and it's not harassment if an employee follows you.

It's not a "theory" that a store can ask you to leave. I have posted verbatim one State's legislated law. It depends on the reason the store asks you to leave though. And that's all they can do. They cannot enforce their 'rules' if it is contrary to the law. In this case it is indeed contrary to the law. An executive order, guideline, recommendation is at all times inferior and subservient to legislated law. See 16 Am Jur 2D Section 98. “An emergency can not create power and no emergency justifies the violation of ANY OF THE PROVISIONS of the United States Constitution or States Constitutions.”
It is unlawful for any company or store to attempt to enforce local ordinances (ie. EO). Only law enforcement can act in this capacity. Legally, it is far better to invoke your medical condition or religious exemption rights. Regrettably here, the current business policy does not acknowledge the Exemption Section for a medical condition of the Executive order [ordinance], or recognize State and Federal law and the civil and criminal consequences for violating such laws. Enforcement of this company policy is impersonating a law enforcement officer and is a crime in this State. This is why the store must call the police. It is only the police that can enforce a law.
It is unlawful to impersonate a peace officer. It is indeed harassment if an individual suffers “mental distress, mental suffering, or mental anguish as demonstrated by a victim's response to an act”.
That being said, you need to review your State law and the Federal law as well. There is no law requiring wearing a mask. In fact, in many States their are laws forbidding wearing a mask or concealing one's identity. We have the overwhelming weight of the law on our side if only people would invoke it.
16 Am Jur 2d., Sec. 97: “Then a constitution should receive a literal interpretation in favor of the Citizen, is especially true, with respect to those provisions which were designed to safeguard the liberty and security of the Citizen in regard to person and property.” Bary v. United States - 273 US 128 “Any constitutional provision intended to confer a benefit should be liberally construed in favor in the clearly intended and expressly designated beneficiary.”
Federal law prohibits the ”denial of participation” from this business establishment as found under 28 CFR §36.202.
Under 28 CFR §36.202(c) further states that unless I have been individually assessed as a “direct threat” you may not exclude me from the same and equal services as others.
Denying service is a violation of Title II, III, and VII of the U.S. Civil Right Act of 1964.
Title III Sections 28 CFR §36.202(a)(b)(c) and 28 CFR §36.203(a)(b)(c) state that I shall not be denied the same participation and equal access as everyone else. The law prohibits any business from treating anyone differently or from serving anyone separately.

Its because it has nothing to do with the mask. It has everything to do with "Criminal Trespass" which the police can enforce. The property owner aka the business no longer wants you on their privart property and thus can have you criminally trespassed.
Um, actually no. What if the store decided to not allow black people. Store manager could say that he or she is afraid that person is part of a gang. Discrimination. The business is NOT considered private if it serves the general public. IF the business requires a membership to join, say like Cosco or a private golf club then they have been able to discriminate on who gets to join. But even that has been fought when excluding people of color.
You cannot discriminate based on race, gender, age, etc. So yes, if you tried to block 'black people' you'd be in trouble. But blocking someone because they won't wear a mask is their right as a private business. Your right is to not shop there.
A private business can implement any rules they want as long as they don't violate the usual 'gender, age, race ...' list. A federal or state building may have a harder time (not sure how the DMV handles this) but a privately owned store can do this. It's not the same exactly, but it's the same 'concept' as how Facebook can delete posts (or GA, for that matter!). Your constitutional right to free speech is all about not allowing the government to stop you, not a private operation. Same goes for masks.

I'm late forties and I remember signs in doorways to certain establishments saying, "No shirt, no shoes, No service" Yes, an establishment has every right to refuse service to you, and especially you, Karen. The best way to rustle a business' jimmies is just not go, and not only just not go but don't tell the business why you don't shop there anymore.
Lack of feedback was my number one buggaboo when I had my lawn service. I did coupons, I did referral discounts, I did almost every trick in the book but my customers were braindead zombies that only knew how to write a check when the bill came in. I could never grow my business so I folded. I was great at lawns but sucky when it came time to collect. Nobody likes to pay their lawn guys. I got tired of hurling rocks through bedroom windows in the middle of the night at the end of every month. Horse heads became an expense that I was no longer able to afford.
One time, totally different company, totally different proffesion, I and my boss were on our way to a cabinet job to install cabinets in Miami, so on the way there, I and my boss worked up quite a pressure. My bladder was overflowing and his bowels were fit to blow, well, me being a spry young lad had raced to the bathroom, (the only one) and did my deed. My boss catches up and tries the door and is pissed that I come strolling out afterwards. Mind you, he's 400 pounds of sheer fast foodery bullshit and his bowels are set to "BLOW" at all times. He was pissed that I dared go in front of him in a single serve bathroom.
That was the reason I quit his ass. Didn't even give him his 2 weeks because my intuition tells me he wouldn't have given me any notice.

I'm thinking all of us need to shop in groups. If I learned anything from Jan. 6th....they won't try shit if there's enough people ignoring the rules. Being female can be especially hard as conflict isn't really something a lot of us are naturals at. I envy the women and men who are able to push back, because it feels shitty for me.
I look at people with a raised eyebrow if they do come into the store where I work with a mask on.
That being said there are some people that really are scared of covid and I think the masks help.

I normally wear a mask just because I don't like confrontation, but I needed coffee this morning and walked into the local market. Shopped and stood in line no problem. Took 10 min or so. But when my card is in the chip reader, seconds away from walking out, the cashier makes a huge deal. "SIR WE REQUIRE MASKS IN HERE WHERE IS YOURS". "Forgot it." Hands me a mask, I put it around one ear but don't put it on. Throw it on the ground after I take my bag.
Won't be going back there.

Anytime they hand me a mask to wear at the register at buy out, I put it on to buy my stuff, and once the transaction is done I immediately take it off and drop it onto the counter for them to take care of as I walk out maskless, just to show how stupid the whole damn thing is.
Yeah it's hard for me to associate or talk with people who are unconscious to the reality. It's really a struggle for me.
You did the right thing.
If you are planning on leaving anyway, you should at least pull a whole bunch of individual items from the shelves and put it in your cart. Preferably from the far corners of the store, and with a preference for things that are obscure so the staff won't know where they go. If it is a grocery store, frozen and refrigerated items are preferred.
Leave eventually, but not before creating an entire basket full of go backs. You can put a lot into a shopping cart in under 5 minutes if you are determined. Then send your friends in after 5 minutes to do the exact same thing. If everyone did this, they'd either change their policy or be swamped under a massive workload.

This was the first it’s ever happened to me. I never wear a mask but I was on a more liberal side of town today. You can tell by all the confused genders and colorful hair.
Rarely confused genders, but it's funny that the colored hair people in my liberal area just don't give a fuck what anyone else does, they just do them.
Fortunately I haven't run into these issues...but I am prepared to cause a scene. I read several books on how to not give a fuck, and I am pretty well versed now.

Don't know where you live or your life situation, but I'd welcome you to North TX. Plenty of scared people here too but I've never been confronted at a major store about a face diaper. This happened to me the other day. I left feeling like I lost, but then I thought about how the person who told me to put a mask on literally has to stand there with a disgusting moist germ diaper on their face for the whole day.

That’s exactly what I did. I was taking my son school shopping at an outlet where most stores didn’t require masks. The few that did ask when we walked in, we turned around and walked out.
I went to Catholic mass yesterday.
When it came time to hold up our hands the guy sitting by me offered to hold my hand.
It was the first time I can think of in damn near the last two years where someone I did not know was not afraid of getting close to me. I about teared up, which tells you how bad things have gotten.
Something fun that I swear to do but haven’t yet (if there’s somewhere I know will make me wear a mask but for whatever reason I don’t want to make a scene, like taking my kid to the library) is to bring my paint respirator and wear that. Then when people inevitably comment on it I’ll tell them that they aren’t being careful enough with their paper masks that can’t block aerosols.
