The Siemens office reopening policy included screening, masking and potentially testing. I responded by electronic and registered mail with a legal Conditional Acceptance letter giving ten days for the HR facilities flunkie to respond. She forwarded it to a HR legal flunkie who told me in a conference call that company lawyers said she didn't need to answer any conditions. So after two weeks I followed up with a Courtesy Notice giving her an additional five days. That pissed her off, "I already told you..." Shortly afterwards, a mandatory vaxx notice from the head of HR popped up in our e-mail boxes. Accordingly I send him his very own new and improved Conditional Acceptance.
Three days later a vaxx policy update came down from on high signed by the CEO, CFO, and HR head. Rather than continue on the other paths, I consolidated everything into yet another Conditional Acceptance that I e-mailed to all, and register mailed to the CEO. Since suits under Common Law are always person-to-person I named the CEO as Principal, and all the others as his Agents. After two weeks I sent him a Courtesy Notice with a five day extension. The CEO never responded -- he pawned that duty off on the HR head who only ever reiterated policy, and would get a little testy when I countered with a sprinkling of facts.
REJOINING OUR STORY IN PROGRESS
This moves us up to early November. Tracking the Biden E.O.s, our vaxx deadline was changed from 8 Dec to 4 Jan with a demand that individuals send in their vaxx status by 26 Nov. Religious and physical exemption applications were also stressed. Exemptions were first put forth as being something that would be rarely granted. At this point I think they are trying to limit the damage -- 100% of the folks I know who applied (3 out of 40 some) received one. I even got an e-mail about my accommodation not yet being received. Could be because I never requested one. Here's my response:

The only accommodation I need to request is from my Creator. Siemens has nothing to do with that. Besides, I already have an accommodation that should satisfy Siemens, it’s known as the 1st Amendment to the Constitution for the united States of America. Something all you Agents of this unlawful action are violating, along with the 4th , 5th , 6th and 14th Amendments.
And let's not forget your violations of all ten points of the Nuremberg Code, which forbids conducting medical experiments of human subjects without their consent. Siemens got away with only paying financial damages for collaborating with the Nazis; many more people are awake to what’s going on this time around, and the evidence is plentiful.

As you can see, I'm not interested in asking for my rights. Instead, as a free man, I am asserting them. But I did get one more Agent to add to my list of enablers. The thing people who apply for these exemptions (and I know many) are missing is that by doing so, they are signing a contract. Whenever you sign a contract you are signing away some liberty, even if you are unaware of it.
This is a classic trap that has been employed by TPTB against We the People since forever. We all do it out of ignorance. By signing this particular contract, the exemption appeasers are agreeing with the premise that their company is entitled to dictate their health care and impose medical interventions whenever it suits them. Can anyone say, "Booster number six?"
I got confirmation that the Courtesy Notice to the CEO was delivered on 12 Nov. A week later I sent out Notices of Default and Estoppel. Here's the cover note:
Dear Mr. H.,
As you have failed to respond to my Conditional Acceptance in affidavit form I am sending you a Notice of Default, and Notice of Estoppel. Going forward I fully expect you to refrain from trying to force unwanted medical interventions upon my person.

Here's the meat from the Default:
Therefore, this NOTICE is to inform you of the fact that you are in DEFAULT due to your failure to perform a legal duty where you had a legal and moral obligation to speak. This NOTICE serves as prima facie evidence of your "SILENCE" in this matter, pursuant to U.S. v. Prudden, 424 F.2d 1021 (1970) and U.S. v. Tweel, 550 F.2d 297, 299 (1977).
BE IT FURTHER KNOWN, that your lack of timely response and failure to rebut my claims in affidavit form serves as your acquiescence and tacit agreement that the factual declarations I set forth are true, correct, and not misleading, and are binding upon you.
And the Estoppel:
Thus, a fraud has been committed upon me, pursuant to U.S. v. Tweel, 550 F.2d 297, 299 (1977), thereby initiating the DOCTRINE OF ESTOPPEL BY ACQUIESCENCE, pursuant to Carmine v. Bowen, 64 A. 932 (1906), to wit, "One's 'silence' may invoke doctrine of ESTOPPEL by acquiescence," which is now in full force and effect upon you and Siemens Industry Software Inc.
BE IT FURTHER KNOWN, that you are hereby estopped from any and all future actions, challenges, or counterclaims against me concerning this matter. Any violation(s) of this ESTOPPEL will be construed, at the very least, as a "tortious" act against me for which I will then have a lawful claim against you. Proceeding beyond this point strips you of any "Immunity," real or imagined, making you personally liable to me.
Finally, yesterday I sent out a document entitled Notice of Liability and Fee Schedule and Demand to Cease and Desist. This was fun, especially coming the day before Thanksgiving! I hope my aggressors read it with joy in their hearts. Here's the cover, short and sweet:
Dear Mr. H.,
The last set of legal documents sent you included a Notice of Estoppel. This final document, a Notice of Liability and Fee Schedule and Demand to Cease and Desist informs you of the personal liability you and your agents will bear, and the damages you and your agents will suffer should you choose to violate said Estoppel.
Merry Christmas, bitches,
Okay, that last bit should actually read "Sincerely,"
And here's the bit from the Liability Notice I am most proud of. I was struggling to clearly hook the legal obligations that public officials operate under into the hides of corporate officers. What I hit on was the 'color of law', which I'll explain after the passages:
YOU WERE WARNED through the aforementioned NOTICE OF ESTOPPEL BY SILENCE AND ACQUIESCENCE that you will be held personally liable for any violation. Such will be construed as, at the very least, a "tortious" act against me for which I will have a Lawful claim and cause of action against you pursuant to 42 U.S.C. § 1983. See United States v. Price, 383 U.S. 787 (1966), to wit, "To act 'under color' of law does not require that the accused be an officer of the State. It is enough that he is a willful participant in joint activity with the State or its agents."
In depriving me of my constitutionally secured rights, privileges, or immunities through forced, unwanted medical interventions under the guise of Executive Order 14043 and the resulting OSHA Emergency Temporary Standard 29 CFR 1910, Subpart U, you are in fact, acting jointly with the State. Furthermore, since neither proclamation is in actuality, a law, you are doing so under color of law, thus making you subject to suits at Common Law under 42 U.S.C. § 1983, and criminal prosecution under 18 U.S.C. § 242. The staying of the OSHA ETS by BST Holdings, LLC v. Occupational Safety and Health Administration (2021) makes your deprivation of my rights even more egregious.
Color of law is typically used against police who hassle, order, or arrest a person based on some law that is not in fact a real law. (Mask mandates come to mind). In U.S. vs Price it was used to prosecute 18 defendants, only three of whom were state officials, for the murder of three young civil rights activists. It is the basis of the movie Mississippi Burning.
A lower court had released the private 15 from any legal action. This ruling by the Supreme Court overturned that when it found that though not public officials, each of the private 15 was "a willful participant in joint activity with the State." The county sheriff and six civilians were convicted on that basis. Corporations doing the bidding of Biden are certainly in joint participation with the State, which is acting on the basis of no law. Such officers can be brought to heel both civilly and criminally. The criminal penalties range up to life in prison and death.
Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ...shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results, ...shall be fined under this title or imprisoned not more than ten years, or both; and if death results, ...shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.
But here is the absolute juiciest part of the Notice of Liability:
YOU ARE ALSO HEREBY NOTIFIED that any continued action against me shall incur a fee and bill for damages at a rate of $100,000 US Dollars per day, per man or woman involved.
YOU ARE THUS HEREBY DEMANDED TO CEASE AND DESIST IMMEDIATELY. Any violation of this NOTICE AND DEMAND is your activation and acceptance of the above fee schedule. This NOTICE AND DEMAND is enforceable from the date of notice.
Let's see, 7 Agents times $100K is $700K a day. At that rate it will only take a few weeks to set me up good.
As of tomorrow my vaxx status will be late. That will probably kick off a violation or two. I plan to go into the office next week for the first time since reopening; without mask, screening or hand cleaning. That should provoke something as well. Maybe I'll be able to add a few more Agents to my suit? I could live with a cool million a day.

IMO this is one of the best things happening right now.
We are taught from birth that we must rely on others to do our thinking for us. "Trust the experts", "Trust the science", "Trust your doctor," "Obey your elders," etc.
This training to assign our critical thinking to others is a fundamental part of the glue that keeps The Matrix intact. By your actions you are training people how to escape the Matrix. Even if it is in only one small part of it, it shows the type of path to follow to escape The Matrix; i.e. stopping giving them any power over us, both in our critical thinking and our rights.
This training goes beyond just critical thinking though, into all our inherent power. Hero worship, or relying on heroes to do what needs to be done (like certain Presidents, or "the military", etc.), is us assigning our intrinsic power over to others.
Here you are showing that a single individual has all the real power over their own life. You are sovereign, and you no longer live under the illusion that you are a vassal to a sovereign government (which is also sovereign, but with fewer rights as it is not a natural person). More important than recognizing your sovereignty, you are showing it to everyone.
I applaud your efforts, they are sound and on the right track. No matter how it turns out legally in the fraudulent (unlawful) legal system we live in, your efforts are a declaration to all the world that you grok your rights and are exactly in line with where all our efforts need to be.
The path out of this is We The People standing up (so that the game board falls over). We can't win their game, but we can stop them from playing it. This is the path to that eventuality.

No, an engineer, not a lawyer. As stated in the earlier posts, after starting down this path I found The Commoner Law Group. None of them are lawyers, but a few have been using Common Law effectively in their lives up to this point. I purchased their $15 Medical Freedom package for employees, which laid out the plan, and provided templates.
Like I said in the post, the color of law stuff is my contribution to the effort. I shared it with the 100 or so at the weekly Tuesday Q&A to strong approval. Quality varies, but I have learned a lot at those sessions. Anybody can join, 18:00 PST, 21:00 EST.

Congrats on the sticky and oops, I forgot you posted links to previous posts. I'll have to read those as well. But yeah, being an engineer, this makes sense. :D ALL the engineers I know have a mind for detail, even minutiae, and the patience to look into things and put the pieces together. And I love that the common law group is full of non-lawyers. Citizens, just knowing the protections of the US Constitution and using what already exists, can accomplish great things. I know some people involved in something similar. I also wanted to say I agree about the issue of 'exemptions.' I have said repeatedly here that there really is no need for an exemption when you have the US Constitution guaranteeing (not granting or giving) you your inalienable rights. Reading through it, I found amendments 9 and 14 section 1 quite compelling in terms of supporting one's rights in this particular (pandemic, mandates) issue and have posted about that to numerous people asking. I later learned that a lawsuit against a university (can't remember where, maybe midwest or Louisianna) was won using those exact amendments. Amazing what an ordinary citizen with no specialized knowledge can do/learn simply by READING that magnificent document.
I can't wait to hear the follow up stories to this. It is AWESOME. This is the sort of thing that really gets me engaged and my juices flowing. Today I have a lot of Thanksgiving related work to do but I am going to save this to read your previous posts. Again, thank you fren for DOING this and for posting about it. The really interesting thing about the 14th Amendment is that it was put in to incorporate the freed slaves under the U.S. corporate structure as "citizens" not as "people." A citizen has no natural rights, only granted privileges. One of the people, who after all created the government and own the country, have all natural rights which cannot be taken away from them. So while the 14th can be useful, I prefer being a people.
Oh, I always do. I don't wait until the fourth Thursday in November, either. But what you said here is a very interesting distinction and one I'd like to know more about. Because if memory serves, immigrants who become 'naturalized' are .. what? I always thought of them as American citizens (as I always thought of myself) but that may mean they don't have the same privileges and protections and natural born citizens have. Unless of course that is why the term 'naturalized' is used .. to grant them the same protections, etc. This is something I would like to know a lot more about. Your group is probably a good source, but if you happen to know of any other sources (books, websites) please let me know. Thanks!

Its no different than the govt sticking you with some arbitrary fine for "services" you didn't ask for. Under common law everyone is on equal footing with the govt and in fact the govt is only a corporation itself, acting under "color of law" as OP points out. When you understand contracts you can do the same thing the govt does right back to them. People have been brainwashed to believe the govt just does whatever they want all the time. That's only true because we forgot how to play the game. The pen is mightier than the sword.

So what is common law exactly? Dumb question I’m sure, but I’m medical and know nothing in depth about the law beyond the constitution and bill of rights or the law as it pertains to me taking care of patients, etc.
Not a lawyer, but here goes.
A long time ago the English had laws that applied to everyone. It was roughly based on the Bible. It may have been written down, but it was so long ago we can't remember.
Over time and numerous cases, the law has been updated and interpreted by the judges and the people. Although there is no one "official" source it lives by being understood and agreed by everyone as universally binding on everyone, even the king.
Fast forward to 1776, and the Americans are trained in common law and use it to declare their freedom from England. The constitution is written in context of the common law. Every state is based on it.
It still applies today, and is a framework for every discussion of law. In fact, if we were to abolish the states, the federal government, the queen of england and parliament, we would still have the common law.
Other countries have different traditions, notably Germany, which is the foundation of both Korean and Japanese law IIRC.
This is right on Pede. Not a lawyer? That means you're qualified, because you have Common Sense, which is all you need for Common Law.

Common law were things derived from judicial rulings and not legislature. I think some of it were also things carried over from colonial and Napoleonic times in American history.
And the judicial rulings came from a jury of peers, not a judge. That's hugely important.
And then not informing you they were doing it, and then charging interest on it when they finally alert you.
I'll take brilliance. At this point the whole thing is a game of chicken, and they are playing with a someone who has nothing to lose -- I'm almost 60, comfortable, and have no desire to continue in the employ of Siemens. I am in this solely for the fight. A payout would be glorious, but I don't need it.

Good job! Well presented and justified. I too am sick of these so called mandates. I work in health care on an as needed basis. We all received a letter re. our vaccination status for Covid, which I refused to sign, then next came a mandated flu shot (I fell into the trap of filing a religious exemption). The next day my manager wanted to meet with me with her boss re. a patient complaint. I declined to meet 2:1 without an attorney. Instead I told them I was resigning 2 months early. ( I had already told them 12/31/21 was my final work date because I was sick of masks and mandates). I was always polite. I voiced my “disappointment” re. the downward spiral the medical community has taken, that only I and God determined what I would do with my body. I hope they got the underlying message which was a big FU to the hospital system and I hope I live to see hospital administrators hang or be in prison for life. Please keep us informed of your progress. I am rooting for you! Wish I had known about this before. It would not have made me change my decision about final retirement, but would have given me immense satisfaction to have presented something like this to HR.

When you sign a contract that you didn't realize was binding you can submit an affidavit of truth to crawl out from under it. But FUs can feel pretty good too!

Sounds like the same common law stuff I used to send off to Debt Collectors! They couldn't ever produce anything that showed I had a contract with them and after I got smart I just walked away from their coercion and BS! I was more than happy to arrange payments with the original creditor's which I tried to do, but they were always selling their portfolios off to a Debt Collector because their such great scammers! Debt Collectors can't prove the debt because they buy debt for pennies on the dollar and all they have is a page that lists the debt with no official paperwork which includes the original contract. I walked away from $38,000.00
Yes! Tacit agreement by acquiescence is used quite frequently by debt collectors, because it works.
You took the lead and showed the rest of us by example. Saved this post for when (not if) I need it. But teachers are year by year contract so they can always just not renew after changing contract language and BS me for the reason for nonrenewal.
I wonder if there is a way you can conditionally accept a contract. Once the notices are served it becomes a legal matter, and they take any negative action against you at their peril. Not sure how this work, but it might be an opening.
Well until you're tenured they can always renew or not renew as contracts are yearly.

The beauty of Common Law, is after it fails, you go back and rework your paper and file again. It costs me time. The corporate defendants spend tens of thousands with each go around. And if they fire me, I'll have even more time.

So how to interpret their illegal and unethical stand on the vax? I don't know, so I can only try to wait it out and see what happens. This looks fantastic and I commend you on a job done extremely well. I know a lot about this and have studied it for years. Not as much as you it seems.
My question is about enforcement. No courts are Article 3 courts. So how do you enforce any action against them assuming they do violate your rights or attempt to. Or what happens if they terminate you from the job? How do you go about enforcement?
Don't over estimate my knowledge. I'm getting lots of input from many who are fighting the same battle.
I don't even know what you mean by "Article 3 court." Aren't all federal courts constrained by Article 3?
Technically, termination only strengthens my case. I don't know how to enforce this. Maybe I get an honest judge. But even the crooked ones have to maintain the appearance of following law, precedence and the Constitution.
Maybe I become such a pain in the ass, costing Siemens so many dollars with each filing that they buy me off. I can keep filing -- if a judge complains about something, I fix it. If he's unreasonable, I get a different judge, or I file in a different court, or appeal.
I really don't know yet. I only know of folks who seem to be credible that have had success. So I dream of my day in court.

I hope you strong arm them into keeping your job and those of many that work with you. I am not sure that all Federal courts are Article 3, and think they aren't but that is a point I need to research. I believe it comes down to forcing the court to behave that way because as far as I know all courts now are Admiralty. You may need to change jurisdiction if it ever comes to court.
Please keep us up to date with what happens. I am VERY interested in what happens with you. This could prove to be a proof for many, thousands, millions even.

Courts certainly prefer Admiralty, if we let them get away with it. I pin my hopes on these points: The 7th Amendment says my "Suits in common law" have the right of trial by jury, and the facts cannot be reexamined except by the rules of common law; many (most, all?) State Constitutions declare their courts to be "at Common Law," or, as with Michigan, "courts of record;" Black's Law Dictionary defines court of record as a court at common law.
All theory. Will it fly? It has for some like Bill Thornton, but not so far in the Covid hysteria era.
You can't use common law within a corporate legal fiction.
You are using a legal corporate NAME while at the same time trying to establish common law jurisdiction.
This is not going to work because you can't have your cake (corporate legal fiction employment bound to corporate maritime law) and eat it too (common law).
As mentioned in the post, Common Law is person to person. The CEO is a person, and I am going after him, as are his agents who I am including. The fact that I refer to a legal fiction by it's accepted name is not something I can change or avoid.
My understanding, however is that a free man can step in and out of statute law when it suits his purpose. At least this is what Bill Thornton says, though I can't vouch for it.
A person is a corporate legal fiction though. So my question then is: how are you actually going after him? Through the person or another way?
Very interested though so don't get me wrong, but I have had my fair share of kate of gaia where he explains how deep the corporate legal death-fiction actually is. so long story short is that if you use the legal name you play their legal game.

I know a bit about the corporate personhood, capitalization, etc. but not enough to answer your questions completely. I will have to look at the work of others to know how to handle this.
That said, corporate officers in their professional capacities are indeed legal fictions. However, there is always a real person behind that fiction. My notices stress that I am addressing them in their personal capacity. I would think that takes them out of the corporate contract world and makes things real.

This is ballsy stuff, but necessary. If it doesn't succeed for you and they fire you, you have grounds to file a lawsuit. The question is -- Are they counting on it? That is, the company is wealthy beyond comprehension and you, on the other hand, are limited for financial resources. Going to court requires paying the court.

I know about court filing fees, but the Law Group has been telling us that those don't apply to someone not working in the statute or equity realm. I haven't digested those arguments yet, but will share when I have some experience under my belt.

I'll be catching up on your previous posts. One issue I've been struggling with is "FDA approval" of the Comernity vs the N-tech version. The Nuremberg codes specifically reference expermintal procedures. Any thoughts on this specific point?
It's a bait and switch. Comi-RNA-ty is FDA approved, but it's not available in the US. I don't even think it's being manufactured. The BioNtech approval was a renewal of its EUA, so still experimental. If you get the two approvals, you will see that the products are "legally distinct"

I could name any price I want, but there is an expectation that you can justify what you ask for. How much is a right worth? Loss of a livelihood is something that does have a price, however. Of course, the court can always change your figures.
But in the end, like much of the legal world, it's about intimidation. I want to name a figure that is believable, but frightening to the company agents who I am holding personally liable. But I also don't want to undersell the damage they are doing.

My understanding is that in colonial America, everyone knew common law. In fact, more law books were sold in the Colonies than in England.
Common law comes from the English law of the land, enshrined by the Magna Carta signed in 1215. It is the customs and rules of a people for solving disputes watched over by a magistrate -- a facilitator, not a judge. The real judge of the dispute and the law is the jury of one's peers, where "peers" refers to the peerage -- your jurors are sovereigns like yourself. Judgments thus reached are preserved in the record -- a Common Law court is after all, a "court of record." These cases become the basis for future rulings.
The common law is simple, because it is for the commoner. People like us who have real lives, and can't devote ourselves to esoteric and complicated statute or equity law created by lawyers, judges and bankers to bind us. There are an estimated 61 million statutes on the books. Common law has only four principles:
