A person is LEGALLY said to be divorced if having been married at any time, not 'single' after the divorce.
The same is true about sex. If M at birth, then LEGALLY you're still a Male even after a sex change.

It's a biological distinction resulting in both legal and civil determinations. In order to do this, the law has to distinguish.
Typically, a female guard would search a prisoner sent to jail, which is segregated by sex. When sentenced, the sex determined, the subject is sent to the corresponding sex's correctional facility.
The reasons to distinguish are the subject-at-hand.
To deny distinction legally is the intended slide of the DS imho.

The analogy I use is this: if I was going to report a missing person, what would report that person as being, what they ARE or what they THINK they are? If they stumble across a mangled body, so beyond recognition and have use DNA to ID. The DNA comes back and says that body is this, well it can't be them because they identify as that. Reminds me of the ‘King of the Hill’ episode where the BMV fucks up Hanks drivers license and has him listed as Female Instead of Male, he jumps through all kinds of hoops even going to the Dr and they wouldn’t even sign off on him being a biological male until he submitted blood and dna for analysis. Then all it takes is Dale gribble AKA Rusty Shackleford to list off high profile names and threatens to make phone calls, then boop, the push of a button and the BMV prints it out instantly and corrects it😂😂
Just after 9/11, which came after the signing of NAFTA, knowing what was coming (no really) I watched for BMVs to start replacing managers. They DID. Hispanics were hired in and they began processing illegals by the boatloads, giving them illegal IDs.
