What's obvious is this bill has no teeth anyway. It would be a QUESTION of citizenship on the census that any illegal can still answer YES to, the same way they do for voting.

The govt mails the census to every mailing address so this is literally the exact same problem as mail in voting with no voter ID.

Please stop misrepresenting things with hyperbolic or sensationalist claims. EXISTING LAW ALREADY DOES THIS, the Bill in question would change it to not do that. So what the Democrats unanimously voted to do was to let this continue to happen or to not prevent it.

A BILL

To require a citizenship question on the decennial census, to require reporting on certain census statistics, and to modify apportionment of Representatives to be based on United States citizens instead of all persons.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Equal Representation Act”.

SEC. 2. CITIZENSHIP STATUS ON DECENNIAL CENSUS.

Section 141 of title 13, United States Code, is amended—

(1) by redesignating subsection (g) as subsection (h); and

(2) by inserting after subsection (f) the following:

“(g) (1) In conducting the 2030 decennial census and each decennial census thereafter, the Secretary shall include in any questionnaire distributed or otherwise used for the purpose of determining the total population by States a checkbox or other similar option for the respondent to indicate, for the respondent and for each of the members of the household of the respondent, whether that individual is a citizen of the United States.

“(2) Not later than 120 days after completion of a decennial census of the population under subsection (a), the Secretary shall make publicly available the number of individuals per State, disaggregated by citizens of the United States and noncitizens, as tabulated in accordance with this section.”.

SEC. 3. EXCLUSION OF NONCITIZENS FROM NUMBER OF PERSONS USED TO DETERMINE APPORTIONMENT OF REPRESENTATIVES AND NUMBER OF ELECTORAL VOTES.

(a) Exclusion.—Section 22(a) of the Act entitled “An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress”, approved June 18, 1929 (2 U.S.C. 2a(a)), is amended by inserting after “not taxed” the following: “and individuals who are not citizens of the United States”.

(b) Effective Date.—The amendment made by subsection (a) shall apply with respect to the apportionment of Representatives carried out pursuant to the decennial census conducted during 2030 and any succeeding decennial census.

SEC. 4. SEVERABILITY CLAUSE.

If any provision of this Act or amendment made by this Act, or the application thereof to any person or circumstance, is held to be unconstitutional, the remainder of the provisions of this Act and amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.

Amend the title so as to read: “A bill to require a citizenship question on the decennial census, to require reporting on certain census statistics, and to modify apportionment of Representatives to be based on United States citizens instead of all individuals.”

All R's voted in favor.

All D's voted against.

Won't pass Senate.

So, we have status quo, which I guess Miller is saying the D's will corrupt the vote via illegals.

To clarify, the House Republicans passed a law to count citizens on the census instead of just total population. Dems voted against it but it still passed in the House.

This bill requires any questionnaire used in the decennial census to include a checkbox or other similar option for respondents to indicate whether the respondent and each household member is a U.S. citizen.

The Department of Commerce must make public the number of citizens and noncitizens in each state.

The bill also requires that the statement sent by the President to Congress indicating the number of persons in each state (related to the reapportionment of U.S. Representatives) excludes noncitizens.

Actually there is a tradition in the House that when a member of one party who supports a bill needs to miss the vote, a member of the opposition party who opposes the bill will agree to miss the vote also. Despite the partisanship in the current congress, a tradition such as this will hold especially on a bill such as this that has no chance of becoming law.

I think this is click-bait. They already did this for the 2020 census. Trump tried to fight it and was overruled by the courts.

Also Miller makes it sound like they are adding new seats and/or electors. NO. There are 538 electors - should be 535 but DC was given 3. There are 100 Senators and 435 Representatives (535). That number is not changing. That is also why the number of electors required to win the Presidency is 270 instead of 269 (which would result in a tie).

Do you guys not remember that after the 2020 census, California lost a seat and Texas gained a seat? That was because CA lost population and TX gained. It will be the same for the illegals. It is all a numbers game. That's why illegals are being moved around to places like New York, Illinois, and of course California. They are losing population and the left can't let them lose electors.

Trump will try again to get CONgress to add back the citizenship question by law. It used to be there and the left got it removed for 2020. Go figure.

I'm not sure what Stephen Miller is trying to do, but what he is saying is not true. If you add a seat/elector to one state you have to subtract one from another. It is all based on population and not "areas with the most illegals". It could end up that way, but it depends on whether the illegals even answer the census. A lot of them are paranoid about responding to govt crap (huh, me too).

BTW - I'm not fan of wikipedia but they do have a good page explaining the numbers and why electors for each state can change but the overall number (538) can not.

They have only been able to give citizen criminals (incarcerated or released felons) voting rights in a few states.

So foreign criminals will have to do. Bussing them around to spoil your vote isn’t going to cut it in ‘24—they know that.

They need to steal those representatives numbers because places like CA and MI are loosing so many.
