Paragraph (a)(1) limits the scope of the bill to only officeholders, candidates for office, and PACs. If you’re not one of those, this bill does not apply to you.
Paragraph (b) includes that the entity must KNOW that the image or video is fake (“knowingly cause…”)
Paragraph (a)(3) clearly states that the crime is committed only when the fake meme is used in PAID ADVERTISING (“…in return for consideration”)
Are you currently holding a political office, or are you running for office? Do you intend, as part of your campaign strategy, to spread known deepfake videos of your opponent via paid advertising channels?
If your answer to either of those questions is no, then this bill has no bearing on your life. Calm down.
YOU ARE CORRECT. THANK YOU FOR THE SANITY CHECK.
This bill only applies to persons holding a political office or currently running for office, or who have spent more than $100 advertising for a political candidate... and only applies to PAID advertising.
A BILL TO BE ENTITLED
AN ACT
relating to required disclosures on certain political advertising
that contains altered media; creating a criminal offense.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 255, Election Code, is amended by adding
Section 255.0015 to read as follows:
Sec. 255.0015. REQUIRED DISCLOSURE ON CERTAIN POLITICAL
ADVERTISING CONTAINING ALTERED MEDIA; CRIMINAL PENALTY. (a) This
section applies only to a person who:
(1) is an officeholder, candidate, or political
committee;
(2) makes expenditures during a reporting period that
in the aggregate exceed $100 for political advertising, other than
an expense to cover the basic cost of hardware, messaging software,
and bandwidth; or
(3) publishes, distributes, or broadcasts political
advertising described by Subsection (b) in return for
consideration.
(b) A person may not, with the intent to influence an
election, knowingly cause to be published, distributed, or
broadcast political advertising that includes an image, audio
recording, or video recording of an officeholder's or candidate's
appearance, speech, or conduct that did not occur in reality,
including an image, audio recording, or video recording that has
been altered using generative artificial intelligence technology,
unless the political advertising includes a disclosure from the
person or another person on whose behalf the political advertising
is published, distributed, or broadcast indicating that the image,
audio recording, or video recording did not occur in reality.
"Battle Fatigue". We're so used to seeing blatant abusive laws that it isn't taking much to set us off. Probably leftover from "We have to pass the bill to see what's in it!" - Obamacare.
My reference was to the 1076 page Obamacare bill. Once people realize the Deep State intentionally makes things complicated and keep us busy doing menial BS so that we don't have time to read through those lengthy bills, everyone will be pretty PO'd.
After seeing details it appears this could be used against the left when they take a clip of PDJT and edit it to seem completely opposite what was being said…
I'm praying that Paxton already has that in progress fren.
Speaker Burrows has turned the house over to the democrats.
I can't wait to vote these traitors out.
For what it's worth, the senate seems to be doing great.
The HB 366 doesn't state whether or not it applies only to politicians and persons in the state of Texas... or it applies to images of politicians in Washington DC or California or China or Britain, if that meme originated in Texas.
HB 366 also says "may not cause to be published, distributed, or broadcast political advertising..." and "unless the political advertising includes a disclosure...". What exactly constitutes "political advertising"? If a meme is a political commentary, or meant to enlighten others... that isn't "advertising", unless they are using an incredibly broad term for "advertising" that includes ALL free speech.
HB 366 also doesn't specify what "causing" something to be published, distributed or broadcast means. If I, living in Texas, forward a meme generated in Ohio to a friend living in Florida... did I cause it to be distributed? Does it make a difference that it originated in a state that doesn't have this law?
It's too vague. Maybe the legislature needs to go back and define "political advertising"... and exactly what is covered and not covered by this law.
Read the bill, not what some anon's interpretation of the bill is. This is an advertising regulation to prevent candidates from spreading knowingly false videos about their opponents without a disclaimer.
I stopped arguing why it isn't what everyone keeps trying to say it is. I don't like it - seems stupid, and it was introduced the the ex-speaker and resident alcoholic (at work) who tried to impeach Paxton. Another supposed republican hero tried to introduce an amendment last night to make the incumbent legislators EXEMPT from this law if it ever sees the light of day.
Our Texas legislature sucks. Drunks, RINOs, Bushies (yeah I know)...
It doesn't surprise me. The lege is part-time so we don't get the best people. We get the people that can burn their own money and not miss any of it. Some say they are blue, some say they are red. They're pretty much all blue-purple. It's hard to find someone to replace them since everyone else is busy actually working or trying to find a job.
Don't let these morons tell you we aren't red. We are getting more red. Border towns are going red. I'd love to be able to get this Carlos jackwad's X account killed. Either he is a complete dumbass or he wanted to stir up crap by using Texas. The hand-wringing and fantasy-porn from X accounts is beyond ridiculous.
I feel as many are taking this completely out of context without understanding the true intention of the bill. The bill is nothing more than requiring a disclaimer in a political ad if something was AI generated and does not represent actual events that happened. Not sure I understand the problem everyone has with this.Propaganda is what got us here to begin with. I do not believe that anything should be portrayed as factual when it was not no matter what side of the fence you’re on.
The problem is that this "elite research board" is filled with people who can't be bothered to take the time to actually research the claims they see on social media.
All the OP had to do was read the bill to see that the X post was sensationalizing a non-issue.
We have a VERY long road ahead of us to undo all the brainwashing.
No, what you THINK the law is is repugnant to our Constitution. The actual law is not problematic at all. Stop knee-jerk reacting and READ THE DAMN BILL.
Look for my explanation in this thread if you don't have time to read all 1 page of the bill.
"Readers added context they thought people might want to know
HB366 requires political ads with altered media to include a disclosure stating the content isn’t real. Applies to political ads, not all social media posts or memes. Non-compliance is a Class A misdemeanor. The bill has passed Texas House, under Senate review now."
No need for getting anyone's panties in a twist. Carlos seems to want to stir up some shit is all. Why the sticky, then?
Gaining traction regardless of the actual wording of the bill. This stuff needs sunlight. Every time one of these censorship assholes decided to move us in the direction of the UK, everyone needs to know about it.
This bill was introduced by Representative Dade Phelan who was the former House Speaker who pushed the impeachment resolution against Attorney General Paxton. He was elected by a vote of all Democrat members and a handful of dissident Republicans. He failed to win the Speaker position this session despite his solid Democrat support. The bill must be passed by the Senate and signed by the Governor to become law and the odds of that are probably somewhat less than 0%.
Our Constitution allows the Legislature to meets in regular session for only around 140 days every other year so we are almost out of danger for this term unless the Governor goes off the rails and calls a special session. At least in that event they are limited to the specific subject he calls them for.
Kind of scary people especially on this site don’t read the actual bill and spread this garbage. READ the bill and grow up and do your research before you continue to focus on doom and gloom…
Here is a copy of that House Bill 366. It states that a political meme which does NOT carry their required disclaimer notice... is punishable as a Class A Misdemeanor. In Texas, a Class A misdemeanor is the most serious type of misdemeanor and carries penalties of up to one year in jail and a fine of up to $4,000.

Did you not read the bill?
This is specifically for ads paid for by political groups and it targets ai generated content that could be mistaken for it being real. They need to let. Viewers know it was ai generated. That's all

Pays to actually read. This punishes people who knowingly alter media and use fake images while pretending the images are real.

State law doesn't supercede our 1st amendment.
Yep, lawsuit incoming. I can't believe they did this either and I live here and hadn't heard a word about it.
I'm praying that Paxton already has that in progress fren.
Speaker Burrows has turned the house over to the democrats.

I really like Paxton and I'll pray right along with you.
Read the bill, not what some anon's interpretation of the bill is. There is NOTHING unconstitutional about this new advertising regulation.
That b.s. that they past that shit behind your back. I would imagine law suits are already being drawn up.

I feel like all the laws now are ‘gotcha’ on purpose. They make them vague and ambiguous and then wait to trap people with them. Ridiculous
Did Gov. Abbott sign it into law?
No, it's only passed the Texas House... Senate, then Abbott.
Here's hoping it's law very soon!
So. Who is going to create the first Hot Wheels meme??

Doesn't this bill still have to go to the state Senate?
yes
I learned all I need to know about TX politics in the JFK files and Everything is a Rich Man's Trick. Not surprised at all.
You guys in Tejas get all the good stuff...
Texas, like FL, isn't as "red" as people think it is.
Read the bill, not what some anon's interpretation of the bill is. This is an advertising regulation to prevent candidates from spreading knowingly false videos about their opponents without a disclaimer.
Right - it's more red.

Hot wheels got triggered
Texans had better wake up because before you know the legislature, governership, etc will be taken over by Muslims.

The red states sure go after a lot of freedoms for governments that claim to believe in less government. Texas has also been going after kratom.
we have fake republicans who are dems in disguise. subversion.
Hugghhhhhh
Wouldn't this BS bill be in violation of our FIRST AMENDMENT RIGHTS and therefore be null and void since the Constitution is the Law of the Land?
It passed in Texas similar to the way I passed flatulence
The correct response is to start posting AI generated memes of all who voted Yes on the bill here:
https://legiscan.com/TX/bill/HB366/2025
Also post on X, Truth, Telegram, Instagram, Tik-Tok, YouTube, etc
Make memes of them till they cry. Then make memes of them crying.
