I think there is a solid chance he is states witness. Some fellow pede here just showed me a video that looks like Joan rivers and sounds like her still alive. The prosecution can bring in rebuttal witnesses if they get the okie dokie from the judge. It wouldn't cause a mistrial and happens all the time in trials.
