Declaring administrative hearings a violation of the 7th amendment is an enormous ruling. it's been considered constitutional because you can always appeal the agency ruling in district court, which is incredibly expensive and as a result almost noone ever does it, but you theoretically can.

If SCOTUS backs this it will basically dismantle the administrative state.

All 3 letter bureaucracies should be dissolved. We dont have a king in the US, we have a million little kings in the form of the administrative state. 100% unelected.

I’m looking into buying my first house soon and I refuse to purchase a home with an HOA fee.. I’m also finding that there’s more to buying a house than property taxes and the monthly payments, which I’ve grilled my parents about where all the hidden costs come from and who gets them because it’s insane!

▲ 6 ▼
– summerstormAK 6 points 4 years ago +6 / -0

Be aware that you can get into a house with an HOA even if there isn't any fee. This is just one reason to READ THE REAL ESTATE CONTRACT VERY CAREFULLY before signing it! Almost no one does this.

I recommend looking at using a credit union for a loan. They usually don't have the hidden BS fees.

As a homeowner, I soon learned you really don't own the home. You own the right to live there and pay taxes. If you do not pay your taxes they take your home from you.

Ya, that part sucks. I had to have PMI on my loan, then there's insurance, utilities, and maintenance. That can be the worst part, depending on how old the home is or how it was constructed. My place was 40 years old when I bought it. I've replaced every appliance in 5 years since I moved in and had to fix 2 dozen other things. Youtube is your friend when it comes to home repairs if you don't know how to do a particular job. You're about to discover how good of a plumber, carpenter, landscaper, painter and electrician you can be and if you need to call someone to do a repair, how much that can cost. If the place holds together, however, you pay a lot less than you would in rent and then you have equity also. At this moment, if I was you, I'd save up your money and wait for the imminent housing bubble pop.

This applies to EVERYTHING. Even state courts and traffic courts. You have a right of trial by jury. Period.

permalink parent save report block reply
▲ 29 ▼
– Mcmurdo32 29 points 4 years ago +29 / -0

So if this is upheld, then when a government agency wants to enforce a regulation on a citizen or entity, it will have to sue in court where they will have the burden of proof. Am I understanding this correctly?

permalink parent save report block reply
▲ 16 ▼
– tstr 16 points 4 years ago +16 / -0

Pretty much what it is doing it's beginning the dismantling of the administrative state. The administrative state is where they basically run their own courts and then legislate using the courts which is completely unconstitutional and this is exactly what should happen. Personally I hope they burn the whole f****** thing down.

Also this is one of the weapons the deep state uses to inflict their will on the people so that so this is absolutely wonderful That this is happening

permalink parent save report block reply
▲ 4 ▼
– teppischfresser 4 points 4 years ago +4 / -0

Yes. The title of this post is not entirely correct. The SEC or any federal agency can still regulate markets, BUT they can't be judge, jury, and executioner. You know have to go through proper courts and not the SEC's own court with judges that will not be neutral.

permalink parent save report block reply
▲ 11 ▼
– Darwyn 11 points 4 years ago +11 / -0

Think of it like this. They now have to give you your full due process rights if you demand them. That means a petty bureaucrat has to get a court date and put you in front of a jury to bleed you dry. He can't just call up a panel made up of other petty bureaucrats and get them to rubber stamp your life being ruined.

With the courts being overloaded it will force them to negotiate in good faith and work deals that most likely favor the citizen. The current system is basically hey offer you a "deal" that sucks balls and you either take it or they rubber stamp your destruction. That's assuming you get a nice guy or don't piss him off. Call your IRS agent a son of a bitch and the next thing you know you're doing jail time. Just because he doesn't like you.

Now that same petty son of a bitch has to get a jury of your peers to agree you need to have a hot poker shoved up your ass just because you called him a mean name.

The jury system is broken FYI. People are taught in school to trust authorities and such... don't think for yourself, look it up... trust the government agent... the DA... the IRS/ATF/FBI etc but hopefully we can reverse that problem and with sane juries then proper due process will castrate the government. It will no longer be all powerful. We The People will have power back.

This should also mean you get full due process when you sue them :)

Maybe this will open up the can of worms at the ATF with their stupid $200 "tax stamp" and their notorious, punitive slow-walking of the unnecessary paperwork.. I'd love to get a suppressor/silencer to save what little bit of hearing I have left after all those years in computer rooms. Plus if the ATF is forced to get rid of that scam maybe more people would buy them and use them at the gun ranges.

That just might save some of them from going out of business or being sued for excessive noise pollution by the surrounding subdivisions that want to shut them down.

permalink parent save report block reply
▲ 1 ▼
– Darwyn 1 point 4 years ago +1 / -0

To the best of my knowledge the $200 tax tamp thing is because congress won't fix that properly. That comes from a law written like 150 years ago... if I remember correctly. The cabal won't allow congress to fix it because they want the ATF to be able to harass We The People with stupid BS. Not sure how much this would effect that. Well I do know the one way it would effect it is they would have to give you a trail to say you broke their stupid rules.

Our gun laws need some major reworking. Maybe if we get rid of the deep state cabal that can be done.

▲ 8 ▼
– CheekyBastard 8 points 4 years ago +8 / -0

This is a very good thing. Basically saying that little bureaucrats have NO authority whatsoever to take any sort of action against the people without a trial. Meaning no fines, no jail time, etc. just because some little government fuck says so.

Congress alone has the authority and responsibility to legislate (make law). Congress cannot just delegate away that power to the Executive branch, which then further delegates it away to agencies which mostly aren't even established by Congress but are rather only funded through appropriations.

In other words, Congress has a job. They aren't doing their job, but instead waste their time on bullshit while tasking shitheads to do their job for them.

Lots of agencies like IRS, FDA and everything make rules that sort of follow the law. If it seems like there rules suck and don't do what the law says, too bad follow anyway. Now agencies would have to listen when people say they are being unfair, possibly stop.
