The Executive Branch does not have, and has never had, "quasi-legislative power." Neither do the courts, which is what the current Supreme Court is unraveling.
Congress passes statutes. The Executive Branch implements regulations to implement those statutes. They do not have authority to create regulations that go beyond the statute.
The fact that Congress is made up of mostly gutless cowards, who want to destroy America, and therefore want to pass the buck of responsibility to the agencies, is irrelevant. The Constitution defines what the powers are.
Also, 100% of the power of the Executive Branch is vested in the office of the President. Those other agencies are only a sub-set of that.
If the defendant's delegation is unconstitutional, then most of government is unconstitutional.
Duh!
Justice Kagan, meet the 9th and 10th Amendments. It's about time you fucking read them.
The Executive Branch used to be the Administrative Branch before the Corporation took over and Lincoln became the first executive in charge instead of a real president.
The whole corporate government is a fraud. They were contracted to provide 19 services. Look at them now. It's time to put an end to the United States corp.
Right, however I think the suggestion is that no one is operating the true United States. Instead, there are repeatedly bankrupted corporations that function differently
The "Federal Government" is a corporation/trust. Not unlike McDonalds. McDonalds makes rules and policies for its employees to follow if they wish to keep their job. The "Federal Government Corporation" does exactly the same. Anybody who works for the Federal Government has to do everything the president/legislature decides to make a statute/act/public policy for their employees.
The Catch is this; the cabal tricked the ignorant masses into believing they were EMPLOYEES/DEPENDENTS of the "Federal Government" via the deceptive use of the 14th amendment political status "U.S. Citizen" (originally created for the freed slaves so they had some "rights" not specifically granted by the state of birth.
The "Federal Government" has nothing to do with "Nationals" or "State Nationals" other than to serve in the capacity that their contract (Constitution) requires, i.e coin the money (gold and silver), protect the borders, deliver the mail, etc.
The "President / Congress / Senate of the United States of America Corporation" should have nothing to do with 99.99% of the lives of regular Americans outside of properly performing their contracted Constitutional duties.
People could hardly care who the president was in 1810/1830/1850/1870/etc. It jliterally didn't matter to 99% of the population, as should be the same today had out country not been hijacked by the liege lords feudal system.
We've fallen so far from what was intended, it's almost impossible for most to even consider this is what the ACTUAL "law of the land" says.
Technically we all are, by birth in one of the 50 states. The state department website says we are "both Nationals and U.S. Citizens", just to keep it extra deceptive.
You don't want to be a U.S. Citizen "too", just a National.
Did you go through any type of process to either renounce citizenship, "reclaim your name," or file an affidavit stating you're to be recognized solely as a National?
Do you have any links on the matter I should check out? Anna von Reitz typa stuff?
Anna's process is okay, but it really doesn't matter if you don't know what you're talking about or how to defend yourself in front of a judge. You can do all her documents and a judge will still pull up all your bank accounts, drivers license, social security card, IRS payments, property tax payments, deeds, titles, etc. as EVIDENCE that you're a; U.S. Citizen, Taxpayer, Resident, Person, Driver, etc. etc. etc. These are the "hooks" they have in you, virtually impossible to eliminate, let alone deny.
Can you defend against the judge's accusations and assertions? Do you know what PRESUMPTIONS the judge is ASSUMING are true (unless explicitly denied by you)?
I'd be happy to help you along. Read the above and let me know what questions you have. I can offer you link and link after link of good information.
P.S. You don't want to renounce your citizenship. You'll want to keep that to get all the basic welfare, social security, medicare, etc. available to you. What you want to do is only BE a citizen when it's convenient for you, not for them. That's a deep rabbit hole of learning in an of itself. First step is to know who you are.
The legislature has abdicated its duties even further. Bills put in front of our legislature are not written by our legislature, they are written by special interests who shop them around to legislators, who then sponsor these bills. This system opens up the legislative process to massive abuse. Special interests bribe legislators into sponsoring these bills, bills which are written to benefit the special interest and not the People.
Our entire government in a fraudulent cartel, which in practice does nothing to benefit the country.
This means all Agencies that received the authority of congress, such as the SEC did not (remember 5th circuit said SEC was an unconstitutional agencies and could not fine as it violates the constitution), that means the administrative state created by all these agencies, could be & should be in the chopping block. SEC has no right to fine a company, so FDA and CDC can certainly be included. Please God give the court the power and wisdom to destroy them all.
This btw isone of Gorsuch’s pet pieves, he doesnt like the administative state because the court can only interpret the laws congress made for them, they cannot change the definition of the law. This came up in his hearings.
He said, “if you dont like the courts rulings, change the law”! But congress can not really transfer their powers.
OSHA should be on the list too along with many others, such as the IRS. If theSEC is not empowered to fine(only one of the three branches of government can) the IRS should not have that weapon either.
If EPA is taken down, IRS should be next
IRS Agent Admits Income Tax Is Unconstitutional And Illegal
Sean Adl-Tabatabai
Fact checked
However, an IRS agent has recently come forward and admitted that not only is income tax fundamentally unconstitutional, but it is also illegal for the agency to demand that citizens pay it.
Moreover, the spending by the Federal government and the role of the Federal Reserve in issuing money create overlapping levels of evil that have driven the American people into mere serfs – albeit with cool toys and great TV reception.
Former IRS Special Agent Joe Bannister explains to CNBC what he found out about the reality of the tax code:
Essentially, its many pages are a work of legal fiction, operating under ‘color of law’ and used to oppress the people, and separate established wealth from everyone else.
Bannister argues that by the books, the incomes of most Americans are not subject to the tax code, but the use of intimidation and nebulous code language has prevented the vast majority from discovering the truth.
In this vintage clip, then-Congressman Ron Paul argues that the 16th Amendment wasn’t properly ratified, leaving the 1913 “law” dubious at best.
Nonetheless, the use of intimidation and the custom of “death and taxes” has left millions and millions of people guilty until proven innocent, often labeled as “tax cheats” who are targeted without due process and with police state vengeance… now, they are attaining the power to revoke your passport if you don’t pay what they say you owe!
Will the American people ever be free from the burden of illegal taxation?
The late Aaron Russo, who produced several classic Hollywood films, put it all out in his documentary “America: Freedom vs. Fascism.”
If you haven’t seen it, Russo digs into the questions behind the questions and exposes the naked fraud that is holding America hostage.
This is a must see documentary… and one to share with friends and family while they still have the nation’s ridiculous and obscene tax burden on their minds…
One or two people are just going to get thrown away. We need millions and to this point it's almost impossible for most to believe the truth, let alone stand up and risk everything for it.
I want the IRS and the ATF gone! It would be awesome to be able to purchase my suppressor without waiting 6 or more months to be able to actually own it.
The way Congress works now, they delegate authority and then have endless oversite committe meetings to try to control the various agencies, who want to actually run the country.
Make Congress do their job. Not farm it out so they can have an easier life. The government can be no bigger than the Constitution and human limits allow.
It's this way on purpose for many reasons. Chief among them, politicians can wring thier hands and have hearings to make soundbites for TV and not actually have to do any work. They push off accountability for things they are supposed to have authority over.
EPA protects the worst environmental abusers, Jay. FDA protects the worst pharma abusers. SEC protects the worst financial abusers. FBI and DoJ protect the worst federal criminal abusers.
This is rather fascinating and I was not aware that there was a possible resurgence of non-delegation doctrine. FYI pedes, this doctrine largely comes from Article I of the Constitution.
IF (and it's a big "IF) hardline non-delegationists took over in the SCOTUS, it could have some very, very serious effects.
I'm not sure that it would destroy the administrative state, but it would certainly cripple it until Congress codified/passed laws to address all of the rules that these agencies have created over the years. That could take a very, very long time.
I would also posit that it would also result in a massive number of Executive Orders being declared null and void which would likely be mostly a good thing, although smarter, more well-read folks might disagree with that.
I would encourage everyone to read about non-delegation doctrine because it's fascinating reading. It's clearly not adhered to in this day and age and has been seriously whittled down over the past 150 years due to as best I can tell, simple convenience. It's too difficult to build an administrative monster while adhering to non-delegation doctrine.
In full disclosure, I have no legal background. Just a reasonably well educated anon that finds Constitutional law interesting. Your interpretations may vary from mine after reading up on the subject.
We've not seen a meltdown like this would bring. Oh my, we are talking super, mega, epic reeeeeeeeeeing in tones and screeching previously unknown to todays modern man. Forget the salt shakers, bring the burlap bags!
We thought Roe vs. Wade would do that. But apparently the moneybags who have been funding the rioters are either out of funds or their funds have been tied up. So - maybe no widespread meltdown? Just watching Nancy and Schiff react
would be reward enough for me.
Gorsuch really wants to overturn the Chevron decision, which would be huge. The proliferation of the deep state since that ruling by SCOTUS has been ridiculous. Basically says that he courts will not interfere with the deep state's interpretation of how to administer "laws" passed by Congress, when the DS drafts the "rules."
Chevron is the reason Pelosi said "we have to pass [Obamacare] to find out what's in it." Since Chevron, legislation passed by Congress typically states that the "Secretary" (of HHS, EPA, etc.) shall promulgate "rules" to implement legislation, which is really just the Congresscritters punting what was supposed to be their exclusive law making responsibility. In the case of Obamacare, for example, delegation of the rule making to the "Secretary" of HHS, Katherine Sebelius, is where the death panels came from.
This is boring stuff compared to some of the drama coming out of DC, but as important as overturning Roe.
Congress just factually DOES lack the power under the Constitution to delegate to federal agencies the sole congressional authority to implement policy changes and make laws. There are no ifs, ands, or buts about it. Even I know this, and I am neither a Constitutional scholar nor a biologist.

I would have loved to be a FLY-ON-THE-WALL when Pres Trump was interviewing those 3 SC Justices...imagine the questions on "the administrative state"!!!!!!! There has to be profound judgement on PDJT actions to get those 3 on the court!!!!
This the case where the EPA is being sued by several states over allowing California to dictate emissions laws to the rest of the country and manufacturers?
Those laws have messed up alot of diesel trucks and other vehicles and yes they need to go. They're not exactly green, it just forces the truck to hold onto the soot and burn it off later on and causes al sorts of mechanical problems
I've been amazed that this assumption of law enforcement power by these agencies has been in place for so long, without it being questioned. I've long believed that the EPA should have just been a division of the Dept. of Justice, with any laws pertaining to the environment being handled by that division.
It's not about striping Congress of their power. It's about upholding the Constitution, and that means Congress cannot delegate their power to anyone else. It was given only to them.

Yes. Legislative creates laws within the foundational allowances provided by the Constitution.

IRS!
I want the IRS and the ATF gone! It would be awesome to be able to purchase my suppressor without waiting 6 or more months to be able to actually own it.
Pray.
6 months? Ha! I wish. Next month will mark one year waiting for my form 4. I guess you did say "or more".
That sucks :/
Got mine in 4 months with the new process they rolled out in Januaryish.
Education is also very high on my list.
I didn't think it was actually part of the federal government.
Yeah, everyone who should be adhering to policy....not making it. Will be impacted. This is vast.
I work for one of these, and I still want them gone.
It's nice to know one of us is inside the beast.
No kidding. All woke.... just trying to get through until we can make alternate plans. I used to love my job, but it totally sucks now.
All of them.
"Going to tear this whole diseased temple down... it's going to be biblical"
It would make sense why Trump keeps saying we will be very happy...
absolutely. Returning power to the american people.
They won't be missed. The irony would be if the citizenry drove them out with fully automatic weapons.
CDC, DHS, DEA, FDA. fuck em all, literally bureaucratic parasites.
This case has the potential to RETURN POWER TO YOU - THE PEOPLE.

The destruction of the administrative state would be a huge win for humanity. THIS would be bigger than I ever imagined or hoped for.
That would ALSO INCLUDE THE SES...The Senior Executive Service put in by...JIMMY CARTER!!!!!
That would go a long way to get this country back on track getting rid of the SES!!!!!
Wow, how have I not even heard of this. Time to do some reading!!
Would it though? I thought the SES was outside the authority of the commander in chief and above all the federal departments? Literally the DS...
Yep, he's an alt-left extremist.
Interesting question on what they would try to "fix" first? Do they go for the money or control.....IRS or DHS? Nanshee would be drunk 24X7.
Yea, well, hopefully when that train stops, she gets out and passes out on the tracks.
Don't forget the Department of "Education".
Good catch, money, control or brainwashing.
CDC is a privately held, for-profit company. Guess what they sell? Vaccines. Imagine that.
I’m not following shit from the CDC

Prophetic
Dismantling the administrative state would go a long way towards draining the swamp.
Lol. That would pretty much be the swamp 80% drained.
