The Executive Branch does not have, and has never had, "quasi-legislative power." Neither do the courts, which is what the current Supreme Court is unraveling.

Congress passes statutes. The Executive Branch implements regulations to implement those statutes. They do not have authority to create regulations that go beyond the statute.

The fact that Congress is made up of mostly gutless cowards, who want to destroy America, and therefore want to pass the buck of responsibility to the agencies, is irrelevant. The Constitution defines what the powers are.

Also, 100% of the power of the Executive Branch is vested in the office of the President. Those other agencies are only a sub-set of that.

If the defendant's delegation is unconstitutional, then most of government is unconstitutional.

Duh!

Justice Kagan, meet the 9th and 10th Amendments. It's about time you fucking read them.

The Executive Branch used to be the Administrative Branch before the Corporation took over and Lincoln became the first executive in charge instead of a real president. The whole corporate government is a fraud. They were contracted to provide 19 services. Look at them now. It's time to put an end to the United States corp.

The "Federal Government" is a corporation/trust. Not unlike McDonalds. McDonalds makes rules and policies for its employees to follow if they wish to keep their job. The "Federal Government Corporation" does exactly the same. Anybody who works for the Federal Government has to do everything the president/legislature decides to make a statute/act/public policy for their employees.

The Catch is this; the cabal tricked the ignorant masses into believing they were EMPLOYEES/DEPENDENTS of the "Federal Government" via the deceptive use of the 14th amendment political status "U.S. Citizen" (originally created for the freed slaves so they had some "rights" not specifically granted by the state of birth.

The "Federal Government" has nothing to do with "Nationals" or "State Nationals" other than to serve in the capacity that their contract (Constitution) requires, i.e coin the money (gold and silver), protect the borders, deliver the mail, etc.

The "President / Congress / Senate of the United States of America Corporation" should have nothing to do with 99.99% of the lives of regular Americans outside of properly performing their contracted Constitutional duties.

People could hardly care who the president was in 1810/1830/1850/1870/etc. It jliterally didn't matter to 99% of the population, as should be the same today had out country not been hijacked by the liege lords feudal system.

We've fallen so far from what was intended, it's almost impossible for most to even consider this is what the ACTUAL "law of the land" says.

Technically we all are, by birth in one of the 50 states. The state department website says we are "both Nationals and U.S. Citizens", just to keep it extra deceptive.

You don't want to be a U.S. Citizen "too", just a National.

Anna's process is okay, but it really doesn't matter if you don't know what you're talking about or how to defend yourself in front of a judge. You can do all her documents and a judge will still pull up all your bank accounts, drivers license, social security card, IRS payments, property tax payments, deeds, titles, etc. as EVIDENCE that you're a; U.S. Citizen, Taxpayer, Resident, Person, Driver, etc. etc. etc. These are the "hooks" they have in you, virtually impossible to eliminate, let alone deny.

Can you defend against the judge's accusations and assertions? Do you know what PRESUMPTIONS the judge is ASSUMING are true (unless explicitly denied by you)?

Yes. Legislative creates laws within the foundational allowances provided by the Constitution.

The Executive implements (among other things, being the leader of the country for example)

The Judicial arbitrates based on the Constitution and the laws passed by the Legislative.

The legislature has abdicated its duties even further. Bills put in front of our legislature are not written by our legislature, they are written by special interests who shop them around to legislators, who then sponsor these bills. This system opens up the legislative process to massive abuse. Special interests bribe legislators into sponsoring these bills, bills which are written to benefit the special interest and not the People.

Our entire government in a fraudulent cartel, which in practice does nothing to benefit the country.

This means all Agencies that received the authority of congress, such as the SEC did not (remember 5th circuit said SEC was an unconstitutional agencies and could not fine as it violates the constitution), that means the administrative state created by all these agencies, could be & should be in the chopping block. The way Congress works now, they delegate authority and then have endless oversite committe meetings to try to control the various agencies, who want to actually run the country.

Make Congress do their job. Not farm it out so they can have an easier life. The government can be no bigger than the Constitution and human limits allow.

This is rather fascinating and I was not aware that there was a possible resurgence of non-delegation doctrine. FYI pedes, this doctrine largely comes from Article I of the Constitution.

IF (and it's a big "IF) hardline non-delegationists took over in the SCOTUS, it could have some very, very serious effects.

I'm not sure that it would destroy the administrative state, but it would certainly cripple it until Congress codified/passed laws to address all of the rules that these agencies have created over the years. That could take a very, very long time.

I would also posit that it would also result in a massive number of Executive Orders being declared null and void which would likely be mostly a good thing, although smarter, more well-read folks might disagree with that.

I would encourage everyone to read about non-delegation doctrine because it's fascinating reading. It's clearly not adhered to in this day and age and has been seriously whittled down over the past 150 years due to as best I can tell, simple convenience. It's too difficult to build an administrative monster while adhering to non-delegation doctrine.

In full disclosure, I have no legal background. Just a reasonably well educated anon that finds Constitutional law interesting. Your interpretations may vary from mine after reading up on the subject.

Gorsuch really wants to overturn the Chevron decision, which would be huge. The proliferation of the deep state since that ruling by SCOTUS has been ridiculous. Basically says that he courts will not interfere with the deep state's interpretation of how to administer "laws" passed by Congress, when the DS drafts the "rules." Chevron is the reason Pelosi said "we have to pass [Obamacare] to find out what's in it." Since Chevron, legislation passed by Congress typically states that the "Secretary" (of HHS, EPA, etc.) shall promulgate "rules" to implement legislation, which is really just the Congresscritters punting what was supposed to be their exclusive law making responsibility. In the case of Obamacare, for example, delegation of the rule making to the "Secretary" of HHS, Katherine Sebelius, is where the death panels came from.

This is boring stuff compared to some of the drama coming out of DC, but as important as overturning Roe.

Congress just factually DOES lack the power under the Constitution to delegate to federal agencies the sole congressional authority to implement policy changes and make laws. There are no ifs, ands, or buts about it. Even I know this, and I am neither a Constitutional scholar nor a biologist.

This the case where the EPA is being sued by several states over allowing California to dictate emissions laws to the rest of the country and manufacturers?

Those laws have messed up alot of diesel trucks and other vehicles and yes they need to go. They're not exactly green, it just forces the truck to hold onto the soot and burn it off later on and causes al sorts of mechanical problems

I've been amazed that this assumption of law enforcement power by these agencies has been in place for so long, without it being questioned. I've long believed that the EPA should have just been a division of the Dept. of Justice, with any laws pertaining to the environment being handled by that division.

It's not about striping Congress of their power. It's about upholding the Constitution, and that means Congress cannot delegate their power to anyone else. It was given only to them.

The quotes cited in the OP are from some dumb bastard who is alarmed that the government might actually be held to what the Constitution authorizes, and nothing more.

By using terms like "resurrect" (like it's a dead, rotting thing) and "doctrine" (like it's some invented oddball belief rather than law of the land), the left-wing robot tries to make it seem arcane and freakish, rather than being what the Constitution states.
