Eh in this case it'd be a small enough lawsuit that they'd probably get busted, only for the lawsuit to get a lot of news/traction because of the precedent it sets.

You never know, but it seems like they still have to very carefully curate the ones they rig.

Although this is not a HIPAA situation, I do think HIPAA should be used in a lawsuit.

HIPAA only applies to health care administrators in the billing department and health insurance companies or Medicare administrators. It applies when the service provider provides patient records for purpose of billing and payment.

Those people are required to keep records confidential.

The interesting thing is that it is a huge fine for a violation. The fine is $250,000.

I think that is clear evidence that the federal government takes seriously the security and confidentiality of health records, and should be justification for suing a private business for $250,000 for demanding disclosure of health records.

Don't know what a court would do with it, but it would be worth pursuing to see what happens.

You cannot demand that anyone divulge sensitive medical information about themselves nor can you release that information about someone else without thwir express written permission (such as you would see in an informed consent form in clinical trials, where certain pieces of health information are collected and used for analysis). This is against the law.

I just assumed cause there are federal laws protecting peoples medical records. One exception is schools for minors needing immunization records, but that's different than a private business. Because schools are government run, they are public sector. And that said, i think its bs that schools require that.

Your spouse is wrong. HIPAA only applies to covered entities and their business associates. It doesn't apply to anyone or anything else.

Correct - which was part of my point - public servant/govt infringement.

There's a difference between "shouldn't do and is generally shitty" on the part of a non-govt entity and 4th amendment violation on the part of a govt entity/public servant.

I'm not saying "no rules" or abiding by the spirit of the 4th for non-govt entities or individuals, but I, individually, cannot violate your 4th amendment rights.

Example: if I break into your car and take something, and give it to the police as evidence of a crime, the 4th amendment doesn't provide protection against use of that evidence. (Still may not be admitted, but not due to 4th amendment violation).

However, if a cop does the same thing, it IS a 4th amendment argument.

In a civil case, the warrant requirement is in order to enforce a subpoena or court order (govt), to retrieve the information I'm looking for. But, that's just if I try to get it legally. Again, I'm - individually - not held to the constitutional provisions of the 4th.

No-ish. First, I'm not defending the request for proof - it's BS, and I agree with u/PeachAndLovePatriot

It's not a violaiton of HIPAA - why? HIPAA covers the medical providers and recipients of PII and health-records. It's a privacy and portability regulation to permit sharing of necessary records among materially-involved parties, as well as the subject party's ability to know and control what is shared.

ADA has a bit more coverage, but only if you can argue that you are being discriminated against on account of a disability, and that would have to be a disability that would prevent use of a mask. In that case, you could still be denied travel, and would have to fight the response in court, and disclose (as evidence) your disability. You'd also have to demonstrate you gave the airline sufficient information to show that their decision was informed and discriminatory.

Bottom line: I can ask. You don't have to tell me. I "can" refuse service.

Now, the tricky part for the businesses becomes "Why can a business be protected in THIS case, but be forced (under 1st and 14th amendments) to bake a cake, provide church services?" THAT'S the slippery-slope they've created with those cases. Good luck, though, getting those entered as cited cases if you're fighting it, because we've all seen how corrupt and poisoned the judiciary has become.

As you reach here: for the record. I have not worn a mask. I refuse to wear a mask. I refuse to patronize businesses that demand masks. I will not fly for this reason.

I am simply stating the lack of actual applicability of HIPAA in this scenario. ADA, marginally, but you've got some burden to prove it. Retail will probably give up when pushed. Airlines will hold firm.

Now, it WOULD be a HIPAA violation if the retailer used your proof-of-vaccine to call the provider/doctor to verify it. Especially if the provider confirmed it - this falls entirely in HIPAA camp, as it involves you (patient) and the provider, who are covered subjects and parties under HIPAA.

Ironically, Seal Beach much like Huntington Beach in the past was looked upon as a "poor mans" Newport Beach. So, once upon a time it was super affordable to purchase a home in Seal Beach and because of that it has a very heavy first responder community made up of Police, Sheriff and Fire Fighters... think "red as red can be." Seal Beach is also one of the safest cities to live in (in regards to population size) along the coast of California.

This store fucked with the wrong community. And they are finding out.

Not my freedom it didn't. I never locked down. I never sheltered in place. I travel when and where I want to go. I will wear a mask to avoid confrontations with the genuinely scared covid cowards, but that is my choice. I take it off whenever I want too.

I agree, they are allowed to limit the number of customers they serve based upon arbitrary rules. However, if this becomes standard practice this policy would become quite discriminatory.

Its not a HIPAA violation. HIPAA only applies to entities that provided you with medical treatment. Anyone else can ask for them, condition their help on your disclosing them, or publishing them if they found them on the street, and HIPAA wouldn't apply.

Its not. As is par for the course around here, most people on here don't know what the fuck they are talking about. HIPAA applies to entities that provide medical care, and entities that are contracted by them to provide services. It doesn't apply to anyone else, and does not make it illegal to ask you for a medical history.

You’re right on this. It’s only a potential hipaa violation if someone else shares your medical information without your consent (and not even always then). This is a bad idea, but not illegal on its own.

But what about a refusal of service based on medical documentation?

I understand that businesses typically reserve the right to refuse service to anyone, but doing so based on medical records sounds like it may be illegal.

San Diego is breeding ground for this ...I have stood my ground here in SD against the mask mandate, I’ve never wore one ... honestly I never see anyone here in San Diego where I live without one. I actually wear a little badge that I made up my self it looks official it’s a medical exempt little badge card that I wear on a lanyard! however, it’s been getting even harder with that! shamelessly I now pretend when I’m attacked and confronted at the door or once I enter.. that I can’t speak and I mouth the words “I have a medical exempt” and point to my badge ! I’m usually treated quiet kindly after that ..shameful I know but whatever it takes . I refuse to bow!,,, however this new “no shot no service” some who commented on here are correct , many elite and yuppies are pro proud of their poison shot and want to be protected from us .. and would prefer not having to ever dine etc with us commoners ! they wanted to live in “ their world “ without us before ....this gives them somewhat of a legal right .. it’s happening , Many will say it can’t hippa etc ..but we never thought the mask or vaxx situation would happen either, so if something doesn’t turn around soon it will happen, the masses here are demanding it. It’s against the law to enforce a mask in CA but stores do , they get away with it by saying that we can order our groceries online and have them delivered they’ll say that going to a restaurant and eating is a luxury, we can have the food delivered it’s horrifying!

I was stationed at Pendleton so I have a fondness for San Diego. Some of the best restaurants. I feel like in a short time, we will know the answer whether or not the vax is harmful or just a placebo. Till then, if I were you-I’d not give them my business. It seems stressful. I don’t blame you for wearing an exempt badge. That’s a good idea for many anywhere struggling with mandates, actually. But-if they’re going to be such flaming a$$holes about this, then they deserve to go out of business. I’m sure you’re not the only one who thinks it’s all BS and are offended by the overreach.

You could also ask these businesses this-if the CDC says you’re still contagious even after having the vax (and they’re for sure saying this; you still have to wear a mask after vax, still have to social distance, still can spread the disease) then what good is the vax? That’s my current question.

And over my dead body will I ever submit to the vax.

Also, I look at it like this. It’s wartime. We’re at war. I’m not sure our sacrifices of not going out to restaurants and finding unique ways of socializing is really that bad. I’m not saying this to patronize. I’m just saying-they don’t deserve our business and we can use our creativity to figure out new ways of coping. Supper clubs is one way. Meal delivery services are cool. I get one that I really like 3 days a week for two people. I can cook a good meal for someone else and enjoy a bottle of wine or whatever for a lot less money and stress than going out to eat and getting enraged. Because that’s the first thing that happens to me when I go anywhere requiring a mask. I always say loudly “ok I’ll put on my worthless commie mask” and I remain agitated the whole time. Ugh sorry this is long. I’m with you, though.

Agreed. It’s enraging we are pulling back on expenditures in general. Wish we could make it known publicly why we aren’t going to certain stores/restaurants/etc.

The Democrats will use the panic of the ‘pandemic’ to implement.... and even comments or rather threads on here and other Q sites will be used for justifying such moves and normies will ask for it... threads like forging vaccines papers or ignoring mask mandates and comments agreeing with that will be blown up by the MSM narrative ..... it’s all in the UNs agenda 2030 and 2050.... which we are signed up to....

It’s important for us all to understand that some of those creating such threads can be the enemy hoping to get us biting at these sort of issues.... be always aware that any thread can be a trap for some on here to respond to.... and later on those comments will be used to justify their plans to implement Social Credits... like if you post a comment on twatter (when these social credits com) and it offends someone then you will get negative credits and that might prevent you from being allowed in to your town to shop or from travelling out of town.... the whole concept has been trialed in Chyna with help from Silicon Valley....!

Vaccine passports and control of movement even at moving around town is coming...
