Also it was held in a regular federal court, not a military tribunal.

It's still a serious crime.

As far as I understand, impeachment is, by definition, removal from office. Why? Because criminal charges cannot be brought against a President while he is in office (just as there are certain indemnities for Congressmen/women, etc)

According to Britannica, for example:

In Great Britain conviction on an impeachment has resulted in fine and imprisonment and even in execution, whereas in the United States the penalties extend no further than removal and disqualification from office.

So in the US, if the person is not in office, they cannot, by definition be impeached. In the US, the entire purpose of impeachment is to remove from office. It's after that all the fun starts.

So, you see, Obama is NOT the President of the United States. He was, now he's not. So he cannot be impeached - cannot be removed from an office he does not hold.

No, Trump is not setting a precedent.

The Court is following the law as stated in Executive Order 13489 which is from 2009 and gave the public greater access to Presidential Records after the Bush White House tried to restrict them. As far as I know this executive order hasn't been superceded.

The incumbent president is the decider. There's a whole section on executive privilege claims by former presidents....... Sec. 4. Claim of Executive Privilege by Former President.

In this case, the claim goes to the Archivist.
" the Archivist shall consult with the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel), the Counsel to the President, and such other executive agencies "

Then the Archivist’s determines if it's a legitimate claim but "In making the determination referred to in subsection (a) of this section, the Archivist **shall abide by any instructions given him by the incumbent President or his designee unless otherwise directed by a final court order. **

Likely manufactured in the same facility, and labeled differently at the end of the line. However, I've seen harbor freight batteries that did not match the normal physical dimensions of a standard AA or AAA battery. They were a full 1/16" shorter in length. Next question.

I'm pretty sure that 5 year rule applies to all POTUS not just Obama. In fairness its a lot of information and they need time to organize it in a way that makes it easy to respond to FOIA requests. They have to determine whats top secret, make redactions, etc etc. Basically government bureaucrats covering their asses.

I'm sure if they had it the way they really wanted it would be 50 years instead of 5. Although I suspect a lot of the FOIA requests in the next few weeks will result in nothing but pages full of black redaction marks. I doubt they will allow anything truly explosive to escape into the wild.

Correct. The Presidential Records Act and the Executive Order discussing how it is implemented applies to all presidents. Obama and Trump have the same 5 year rule.....but a court can make exceptions like what is happening with Trump and Jan 6.

I was following along with Hillbuzz when Obama was running for President. He is gay and lived in Chicago too. There were all sorts of semi-public stories about Obama being gay and using coke. In 2008 I learned more about Obama from a gay Hillary supporter than anyone.
