Hey..now that I’m looking back a bit…didn’t they have a similar ruling last month regarding the OSHA enforcement?
There’s been lots of rulings back and forth while it’s gone through the process. I read legal all day. I had missed the fifth circuit ruling in NOLA that made the stay just for the states suing. For now, the mandates for healthcare workers will stand (same for OSHA) BUT it will be appealed. I’ve been turning this over in my head and reading. Need to read with better clarity tomorrow. The OSHA ruling will likely stand with the 6/4. OSHA concentrates on occupational hazards. Covid is everywhere so you can’t say it’s only hazardous in the workplace. Thus OSHA doesn’t have the ability (or authority) to require a vax.
The things about the healthcare workers is a little different bc it concentrates on CMS, which oversees a federal program. One thing I keep going back to is that one of the challenges was that they did not adequately consider alternative. Watching mainstream media backpedal and all the information about alternative treatments come out has me wondering if this isn’t all part of the movie. We hear daily the hospitals being overrun, stories about vaxed workers being allowed to work with covid. Logically, if the ruling was based on the protection of the patients both of those things should be considered since there are alternatives like ivermectin and vaxed are able to get and spread. I think they have a decent shot at appealing this? Sorry for the paragraph. Thinking out loud I guess.
Hey thanks for clearing that up. I thought I was having dejavu bc I remember last month we were celebrating some Supreme Court ruling that it wasn’t constitutional. But of course there’s the state supreme and then the fed supreme. Maybe that’s where I got confused. It was the Louisana Supreme Court last month right?

It was just one event that occurred yesterday. Filibuster will remain, so there will be no HR1 bill passing, so elections will not be stolen again, and Pennsylvania will go ahead with their audit. Build back better is not happening, so no destruction of economy and creation of socialist state. The mandate would have caused states to go against scotus which could lead to succession or civil war.

I doubt any would be effective. Any companies that fired workers over the mandates did so because they made it a company policy that their workers must be vaccinated or perhaps wear a mask and undergo testing or be terminated. I'm not even sure the OSHA mandate ever went fully into legal effect. Companies can still have such policies too, so just because the mandate doesn't exist doesn't mean some companies won't continue to have vaccine and testing policies on the books. They're free to make their own corporate policies and so some may continue to have such policies even without the mandates requiring them to. Regardless of the arguments at hand, it has generally come down to an issue of employees not complying with company policy, which is legally a valid reason to fire an employee. So yeah, I'm not really sure any lawsuits could get very far. Besides, most of the court systems hugely side with corporations over any sort of worker's rights or protections when it comes down to it, even something like this.

I think te ruling did establish that medical and religious exenptions must be allowed. I don't know if that was originally the plan. Nut i agree that its difficult to reconcile the two. I expected Roberts to cuck on both but he didnt. I still harbor uncertainties about Kav and ACB and i wonder if theres a rotation for them cucking out to not raise awareness to their true allegiances.
Healthcare brings in a ton of money from the federal government through Medicaid and Medicare. It's been a long standing rule they the government can apply certain standards or rules for any healthcare center that can then receive payments from Medicaid and Medicare. And since such a large segment of people who are sick and need constant healthcare, old people or people on disability is a big one, it's basically impossible for a healthcare center to exist without accepting Medicaid and Medicare payments. So it's not exactly a rule for all healthcare workers, but rather a rule for all organizations that take money from the federal government through those programs, which, in the end, is basically all healthcare workers and long-term care facilities.
I wonder if some providers will drop Medicare and Medicaid that have the option to.
I’m reading this way different. There is an injunction in place nationwide for healthcare workers stopping the mandate. The government asked for SCOTUS to lift the injunction. It was denied.

That’s my next step. They were waiting on the ruling before they sent out any rules at work. We were just told if the mandates are allowed then it will go forward February 9. So that is my next step. I will file an exemption but I certainly don’t want to be jabbed 52 weeks out of the year up my nose!
File for an exemption to testing too. Most people don't realize you can file a religious accommodation request against testing arguing something like "I'll take my temperature and answer pre-screening questions like you've done for the last year". Even the OSHA mandate requires employers to allow for religious/medical exemptions against testing.
I'm curious what the religious objection is to getting covid tests? I'm not well versed in some forms of Christianity, so I'm wondering on what basis could one claim an exemption with religious reasoning for why they shouldn't be tested that could potentially hold up for their determination?
The two arguments that come to mind:
The tests are being used to invoke fear in people and to live your life as a Christian you don't want to support fear. You aren't to fear the deadly pestilence and shouldn't make others fear it either.
You're body is a holy temple and render unto caesar what is caesars and what is god what is gods means that you don't give up your body (i.e. saliva/nasal swab) for ungodly reasons.
And really the law is so unbelievably broad you can argue most anything other than science/politics/medical. If you believe the lizard people on mars had a conference that said god wouldn't want anyone to take covid tests, that could technically qualify - although expect resistance on that.

We can’t practice how we think is best, we can’t give the care we think is best. Care that the patient wants or that we discuss with them and they agree with our views.
I had more freedom in private practice but the threats from regulating agencies scare me. Especially if someone sued, I’d have no defense. Both the consumers need to accept risk (as long as it’s not overt like cutting off the wrong limb) and we need regulating agencies to be a small, tiny agency, with only some power like to make obvious points like hand washing.

You allow one to stand but block the other? Makes no sense. They both massively violate the constitution. To allow either to stand is a big blow.

I would only guess that it might help support your argument if there is a lawsuit.
On the negative side it's basically arguing the federal money can be used to force compliance (it shouldn't but thats what they are setting a precedence for).
On the positive side it's forcing them to allow for religious exemptions, which when the military allows for zero exemptions is clearly not abiding by the law.
Unfortunately military has always operated differently than civilian businesses so I doubt it will have an effect. They give cocktails of everything imaginable, and then they tack on extras for overseas deployments (like for SARS). I personally know of a few discharges that were handed out, and a few other people I know are now waiting for theirs still bc their religious accomodations were denied. Makes me sick.

I honestly don’t think so once they find someone to replace you. I just got a hospital job and I’m vaccinated. So everyone was wondering why they put me on the weekend with the most RNs. Well last week I found out three RNs had exemptions they said were good for 12 months and after that if the federal mandate went into effect, they would not get them again because they had taken other vaccines in the past. Basically the hospital needed time to replace them.
And even if it’s not me, they hired three others just for that weekend so they are putting us on the weekend with the most nurses who are unvaccinated. Signaling their intent just to replace them.

Yes if you as a company demand vaccination I think it would be fair for the employee to request you be liable for any damages that may occur. I think if an employee wanted that in writing it would stop most small to medium sized employers. Again supply and demand. If they need workers badly enough they’ll do whatever it takes to get the employee. On the flip side if there’s lines and lines of people waiting for work….well Tata!
Yes, the reason the SC ruled this way is because precedent for mandates were held up by cities or state control.
The most precedent there is, is by a city to mandate it in a health emergency like NYC.
It’s not a federal precedent. Well it is now for healthcare that takes Medicare.
But yes individual and private companies can mandate, they have even more power than cities do to mandate it.

That’s why I took it. Most hospitals will require it even without a mandate. I do know a few RNs and my favorite charge nurse said they had a year, the hospital told them they could keep exemption for a year if it was mandated.
I feel super bad for them but knew it would happen. Hospitals are really fighting lawsuits so it’s the lawsuits that make them act this way. If there were no lawsuits there’d be no rules and doctors would prescribe and practice freely, like in the past.
Opening up lawsuits for providers in the last century has created defensive medicine which is highly regulated. If the hospital conforms to rules of practice, judges know how to rule on cases and it unclogs the courts.
Hundred years ago you just accepted risks and if you asked for help you didn’t sue the people you paid to help you. Imagine if almost every client you took to put in pipes sued you because the house was unstable to begin with. Despite you putting in pipes in a house sinking into the ground because all clients had that condition. You were blamed when the pipes failed. Despite it being evident the whole pipe situation will fail eventually.
Why would anyone take on a sick and elderly patient who will eventually die, or a sick person who will eventually die, if you will be blamed for their eventual death?
So much for all the paperwork patients sign stating that they understand and accept the risks of treatment.

I think the focus is OSHA - so for the crew and workers, yes (the government can’t enforce vaccination). No other regulatory mandate exists, that I’m aware of.
What about the mask mandate on flights? Can the government still mandate that being it’s mandated by TSA?
Airlines are a whole different ball game. Flying on an airline is not a protected right in the Constitution. They can require all sorts of stuff in order to fly with them. They make you remove your shoes and remove your belt after all. The legal argument could also be that wearing a mask does not have any lasting or not reversible effects like getting a vaccine would. It's all separate regulations anyway, and today's court cases have nothing to do with flying with airlines.
